Provinces

  • Not older than 30 years: Authorisation from Director-General required
  • Older than 30 years but not freely accessible due to legal restrictions, for example with regard to the protection of privacy and personal data: Authorisation from National Archivist or his/her representative and signed research declaration required.
  • Older than 30 years but without legal restrictions: freely accessible

District commissioner’s office

The district commissioner is a commissioner of both the federal government and the regional government. The archival rules therefore depend on the framework in which the archives were produced.

Brussels and Wallonia:

  • Archives produced in the exercise of federal or provincial powers
    • Not older than 30 years: authorisation of the Director-General required
    • Older than 30 years but not freely accessible due to legal restrictions, for example with regard to the protection of privacy and personal data: Authorisation from National Archivist or his/her representative and signed research declaration required
    • Older than 30 years but without legal restrictions: freely accessible
  • Archives produced in the exercise of regional powers:
    • Authorisation from the Director-General required

Flanders:

  • Archives produced in the exercise of federal or provincial powers
    • Not older than 30 years: authorisation of the Director-General required
    • Older than 30 years but not freely accessible due to legal restrictions, for example with regard to the protection of privacy and personal data: Authorisation from National Archivist or his/her representative and signed research declaration required.
    • Older than 30 years but without legal restrictions: freely accessible
  • Archives produced in the exercise of regional powers:
    • Not older than 20 years or between 20 and 120 years old but not freely accessible due to legal restrictions, for example with regard to the protection of privacy and personal data: Authorisation from the Director-General required
    • Older than 120 years: freely accessible (if the person concerned is deceased since more than 20 years)
